EASTHAM BOARD OF HEALTH MEETING
THURSDAY, MARCH 31, 2011

PRESENT: Dr. James Taylor, Chairman, Pat Lariviere, R.N., Co-Chairman, Dr. Lois Roth-Johnson, Beverly Knox, R.N., Jane Crowley,M.S.,R.S.,Health Agent, Susan Barker, Assistant Health Agent, Absent-Dr. Martin Haspel
I. OPENING STATEMENTS
Ms. Crowley notified the board of upcoming unused prescription drug disposal on April 30, 2011 at the Eastham Police Department from 10-2pm.
The Board was also notified of the upcoming Rabies Clinic on Saturday April 2, 2011.
II. VARIANCES
1. Cecile Carpenter 163 Samoset Rd Map-15 Parcel-53
Due to the constraints of the lot size of 12,520 sq ft a plan has been submitted with variances for the upgrade of an existing 2 bedroom dwelling. There are no reductions from the proposed leach area to existing or proposed wells. The plan provides a greater degree of environmental protection than previously existed with greater separation distance from well to leach area. The current plan is based on preliminary design criteria where soil evaluation has not yet been conducted.
Finding that the plan achieves maximum feasible compliance, the plan was approved with the following conditions:
1. No increase in flow allowed
2. Deed restriction to 2 bedrooms
3. Well to be tested for VOC and Routine parameters
4. Completed design plan to be submitted to the Eastham Health Agent for approval
5. Well variance form to be signed by homeowner.
Ms. Pat Lariviere made the motion to accept the plan as proposed.
Ms. Beverly Knox seconded the motion.

2. Susan Connor 13 Gails Way Map-13 Parcel-576
Due to constraints of the lot size of 7,500 sq ft and the existing 3 bedroom dwelling J.C. Ellis submitted a plan with requested for 9 variances. The plan includes secondary treatment with Advantex AX20 system under general use approval.
Finding that the plan achieves maximum feasible compliance, the plan was approved with the following conditions:
1. Routine and VOC water quality test results to be provided of proposed well location to assure potability
2. No increase in design flow allowed
3. Secondary treatment and monitoring under general use approval conditions per DEP regulations including quarterly for total nitrogen, BOD, TSS, Nitrate (or two times per year for seasonal use). After this time reduction of testing could be requested to the Eastham Board of Health by owner. Effluent nitrate nitrogen not to exceed 19 mg/L
4. Deed restriction for 3 bedroom use and use of Advantex AX20 alternative technology requirement to be recorded on deed
5. Designer to verify proper operation of the system prior to issuance of Certificate of Compliance
6. Any increase in habitable square footage would require Board of Health review and abutter notification
7. Operation and maintenance agreement to be submitted to Eastham Board of Health. Operation and maintenance to be required for the life of the system. Operator to report results via Carmody Data Base provided through Barnstable County Health or directly to the Eastham Health Department if not available.
8. Deed easement for shared well will be recorded on deed. Attorney’s letter to be also recorded on deed.
9. Homeowner to sign well variance form.

3. Kevin & Aileen Peters 330 Steele Rd Map-4 Parcel-127
Due to constraints of the lot size 12,448 sq ft and the existing 3 bedroom dwelling with a proposed workshop J.C. Ellis has submitted a plan with requests for 8 variances. The proposed workshop meets the definition of a bedroom. The plan includes secondary treatment with Advantex AX20 system under general use approval.
Finding that the plan achieves maximum feasible compliance, the plan was approved with the following conditions:
1. Routine water quality test results be provided of existing well location to assure potability
2. No increase in design flow be allowed (see proposed workshop option A&B)
3. Secondary treatment and monitoring under general use approval conditions per DEP regulations including testing quarterly for total nitrogen, BOD, TSS, Nitrate (or 2 times per year for seasonal use). After this time reduction of testing could be requested to BOH by homeowner. Effluent nitrate nitrogen not to exceed 19 mg/L.
4. Deed restriction for 3 bedroom use and use of Advantex AX20 alternative technology requirement to be recorded on deed.
5. Designer to verify proper operation of the system prior to issuance of Certificate of Compliance.
6. Any increase in habitable square footage would require BOH review and abutter notification.
7. Operation and maintenance contract to be submitted to EBOH. Operation and maintenance agreement to be required for the life of the system. Operator to report results via Carmody Data Base provided through Barnstable County Health or directly to the Eastham Health Department, if not available.
8. Require water tight test of septic tank and pump chamber
9. No in workshop, not to be used as a bedroom.
10. Details to be submitted for retaining wall.

4. George and Susan Amato 95 Harmes Way Map-1 Parcel-101
Continued from February 17, 2011 Board of Health meeting. Plan submitted by J.C. Ellis has secondary treatment with Advantex AX20 technology to be added to the existing leach area.
Finding that the plan achieves maximum feasible compliance, the plan was approved with the following conditions:
1. VOC and Routine water quality test results to be provided of proposed well location to assure potability.
2. Secondary treatment and monitoring under general or remedial use approval (as appropriate) conditions per DEP regulations including testing quarterly for total nitrogen (or 2 times per year for seasonal use). After this time reduction of testing could be requested to Board of Health by owner.
3. No increase in design flow be allowed without abutter notification and Board of Health review.
4. Operation and maintenance agreement to be submitted to the Eastham Board of Health. Operation and Maintenance agreement to be required for the life of the system.
5. Deed restriction for 2 bedroom use and alternative technology requirement to be recorded.
6. Designer to verify operation of the system prior to issuance of Certificate of Compliance.
7. Subject to Conservation Commission review.
Dr. Lois Roth-Johnson made the motion to accept with the 7 conditions.

III. REVIEW
5. Estate of Marianne Simmerl 225 Sparrow Rd Map-4 Parcel-190
East Cape Engineering requested a review of a proposed building project with a request to demolish and rebuild a new dwelling. The property is serviced by an existing Title 5 system which was installed in July 2010 to service the existing dwelling on an environmentally sensitive lot with variances. The system at that time was approved for pressure dosing but no alternative treatment. The proposed floor plan of the new dwelling contains 3 bedrooms and a workshop which could meet the definition of a bedroom.
The proposed project was approved with the following conditions:
1. Use of alternative technology to be added, engineer to submit engineering plans to Health Agent for approval.
2. No plumbing to be installed in room over garage.
3. Deed restriction for 3 bedroom use, deed to state workshop over garage not to be used as a bedroom and/or habitable space.
4. No direct access from workshop over garage to second floor of house.
Dr. James Taylor made the motion to accept with the 4 conditions.

6. Robert & Cheryl Steinbruch 255 Corliss Way Map-18 Parcel-3
East Cape Engineering requested a review of a proposed building permit with a request to demolish and rebuild a new dwelling. The property is serviced by a Title 5 system that was installed in 2005 for the existing dwelling on an environmentally sensitive lot with variances. The system approved at the time had pressure dosing but no alternative treatment for the existing 6 bedroom dwelling on 1.2 acres. The proposed floor plan contains 6 bedrooms.
Dr. Lois Roth Johnson made a motion to accept the plans as presented.

A review of septic plan s submitted by J.C. Ellis for the mixed use retail fish market and take out food establishment.
The discussion has been tabled. The applicant will return at a later date when the establishment closes for the season. In the interim, a water meter is to be added to the establishment in order to accurately evaluate the establishments water use.
V. CORRESPONDENCE/OTHER BUSINESS
The Board discussed possible topics for the next workshop.
